Class Action Suit Alleges Certain Verizon Charges Are Illegal and Cost California Cell Phone Customers Millions

Lawsuit seeks to end Verizon's practice of charging minimum late fees to California customers; claims such fees are illegal under consumer protection statutes that prohibit late fees that exceed actual damages caused by the late payment.

Oakland, CA (PRWEB) June 14, 2007 -- Cellular customers are accustomed to getting hit with extra fees, but a new class action lawsuit alleges that Verizon Wireless's late payment policy takes this too far. When Cathy Gellis paid her $131 cell phone bill a few days late, Verizon Wireless tacked on an additional $5 minimum late fee, resulting in a 154% annual interest rate charge for a payment that turned out to be about nine days late. A class action lawsuit filed June 12 in Alameda Superior Court alleges that such late fees are well in excess of what California law allows.

Marin-based plaintiff's firms Brayton Purcell LLP and Chavez & Gertler LLP are jointly representing Ms. Gellis and the proposed class of affected Verizon Wireless customers in the case titled Catherine Gellis v. Verizon Communications, Inc., Verizon Wireless and Cellco Partnership (Alameda Superior Court, RG 07330354).

"As far as consumer contracts like this are concerned, companies are only allowed to use late payment fees to recoup the actual costs associated with the late payments. We believe that these late fees are wildy inflated relative to that standard, with the intent and effect of having the fees operate as a profit center, charging California users millions in extra penalties in order to pad Verizon Wireless's bottom line," said Brayton Purcell attorney Peter Fredman.

Verizon Wireless imposes the late charges pursuant to a provision of its standard Customer Terms & Conditions that allows for a late charge of 18 percent annually, or a flat $5 fee, whichever is greater. The lawsuit alleges that this provision is in violation of California law, which permits a company to charge preset fees of this type only when it is "impracticable" or "extremely difficult" to ascertain the actual damage.

"It is clear that Verizon does not incur anywhere near a $5 cost for the late payments to which it applies this minimum charge. The company is simply taking advantage of fine print in the contract, the inability of individual customers to bargain for their rights, and the fact that consumers are locked into these contracts for 1-2 years and have no choice but to pay," said Mark Chavez, of the class action firm Chavez & Gertler. "Fortunately, California law protects consumers against this unconscionable use of late fees."

According to the complaint, the actual carrying costs that Verizon Wireless incurs in connection with a late payment are well known to Verizon, and the $5 minimum fees are applied automatically by billing software. "Verizon Wireless may be entitled to charge a fair interest rate for the period of time the payment is late," Mr. Fredman explains, "but that's all they can charge in situations like this, where the fee is imposed without any human action at no discernible cost to Verizon". The complaint alleges that "the $5 minimum late fee drastically exceeds the actual cost to Verizon Wireless in every instance in which it is applied."

Mr. Fredman also noted the fundamental unfairness of these late fee practices because they result in disproportionately higher late charges to customers with lower bills without corresponding expense. For example, Verizon Wireless charges the same $5 late fee to a customer who pays a $40 bill five days past the due date as they would charge to a customer who pays a $300 bill 30 days past the due date.

eBay Alerts Make it Easier for Mobile Consumers to Bid More and Win More

LAS VEGAS, NV, June 14, 2006 - eBay today introduced eBay Alerts, an extension of eBay Wireless which enables users to win more listings on eBay even while on the go. eBay Alerts, unveiled at the fifth annual eBay Live! Community Conference, notify users with eBay listing updates through phone calls, text messages and instant messages, and allow users to bid on auction-style listings from their wireless devices.

"As consumers' lifestyles become more mobile, eBay Alerts help by driving more demand to our sellers and making it easier for our buyers to stay involved in the auction process before an item listing closes," said Eric Shoup, group product manager of eBay Wireless.

eBay buyers can elect to receive a phone call alerting them that three minutes remain before a listing ends. The service gives buyers an easy and convenient way to check an item's status or place bids by phone. This feature will be available in July and will be rolled out as a pilot program. The phone call alerts are powered by UnWired Buyer, provider of an event-triggered, voice-based e-commerce platform and a member of the eBay Developers Program.

In addition, eBay buyers can choose to receive bidding update alerts and bid on items via text messages on mobile phones. Known as SMS alerts, users can receive "outbid" and "item ending soon" text messages for any item they choose and can re-bid via SMS. There is a nominal fee associated with SMS alerts of $0.25 for up to 10 messages per item that will appear on the user's cell phone bill. SMS alerts will become available during the week of June 11th. VeriSign delivers eBay's SMS alerts in the U.S. using VeriSign's Intelligent Messaging Network.

Similarly, buyers can now receive "outbid" and "item ending soon" alerts using AOL Instant Messenger, Yahoo! Messenger, or MSN Messenger for any of the items they are bidding on. This service will also be available via Skype in 2007. As a part of this free notification service, eBay will send a link leading back to the item on eBay, where buyers can increase their bid if they wish. This service becomes available at the end of June.

At this time, eBay Alerts are available in the U.S. only. Links for all three methods have been added to item pages across the eBay site, so buyers can simply choose any or all types of alerts for a particular item. Plus, users can set their overall preferences in "My eBay" to receive a text message or instant message.

Resellers who are not prepared to meet one of the four commitment levels can purchase individual packages at a discount rate and can scale up at any time. This, along with the ability to customize packages for each client, enables the resellers to more effectively set and control their own profit margins as well as to serve customers with immediate needs and limited investment capital.

The white label program will allow users to re-brand Junction Networks' existing management portal, including graphics and color schemes, by submitting a custom style-sheet to be applied to Junction Networks' functional portal. Resellers who already operate their own communications management portals can integrate all or part of Junction Networks portal through the web services open source API. This includes billing, call detail records and phone number databases

"It is important for resellers to provide as seamless a package as possible to their customers," Wolpov said. "Junction Networks' white label program web services API give them the opportunity to further develop and maintain their brands by offering a management portal and user interface that appears as if they built and designed it themselves."

Cleves is a natural choice to lead Junction Networks Hosted PBX reseller program. He was previously the head of sales and marketing for Broadband Properties, the leading source of information on digital and broadband technologies in the fiber-to-home area. He has also worked as a technology manager for GenSage, inc. a genomics company, and InterPort Communications, a New York-based ISP, where he was manager of dedicated sales.
